Before using any of the services provided by Excel Business Insights you the client are required to read, understand and agree to the terms. By using any of the services of Excel Business Insights you agree to the terms that have been specified.
This agreement constitutes the terms of business between Excel Business Insights and you as the client. The following terms and conditions will govern matters between Excel Business Insights and the client and will be legally binding. The terms and conditions can be seen below.
- Scope of Services – Excel Business Insights will attempt to complete the task within the required period of time however cannot guarantee this. Work will only be performed on the basis that it conforms to the specified services. Excel Business Insights reserves the right not to perform work that is not in the remit of services offered.
- Compensation – Clients must pay the required amount to Excel Business Insights for work done immediately. The only instance when payment is not required immediately is when the client issues a purchase order number. Excel Business Insights reserves the right when to accept a purchase order number.
- Late Payment – If payment is not made within the required period of time Excel Business Insights has the right to undertake collection and enforcement efforts if payment is not made within the required period of time. All collection costs such as legal fees and otherwise will be made to be paid by the client. If payment is late Excel Business Insights has the right to withhold and/or cancel any existing and further services provided.
- Refunds and Disputed Charges – Written notice of any disputed charges must be made within 30 days of the performance date otherwise the client forfeits the right to dispute. Excel Business Insights will determine if the client has a valid dispute. If there is a valid dispute the funds will be refunded back to the clients account.
- Ownership of Work – Excel Business Insights has ownership of all original source codes such as Formulas & Automation, Data Cleansing & Data Analysis, Interactive Reports & Dashboards, Integrations, Bespoke Solutions, Financial Models and anything else. The client has a perpetual license to use the work done for its own purposes.
- Confidentiality of Information – Excel Business Insights acknowledges its responsibility both during and after the engagement to preserve the confidentiality of any proprietary or confidential information or data obtained from the client or developed by Excel Business Insights.
- Damage Limitation and Indemnification – Excel Business Insights, its owners and its agents, officers, directors, lawyers, accountants, and employees cannot be held responsible for any consequential or incidental damages resulting from Excel Business Insights services. No such claim for losses, demands, damages, liabilities, costs, expenses or anything else can be claimed as a result of work done as it is the sole responsibly of the client to ensure they are satisfied with the work done by Excel Business Insights and that the work done is correct.
- Unlimited and reasonable use – Clients are allowed to request further amendments to be made under the reasonable use clause. Reasonable use is determinate by Excel Business Insights. However, if Excel Business Insights believes a client to be abusing the service then Excel Business Insights retains the sole and absolute discretion to suspend use of the service. Each request is subject to a maximum of 60 minutes of development. Every 60 minutes of development thereafter will be regarded as an additional request. Excel Business Insights has the sole right to determine the development time.
- Change of Terms of Service – Terms of service can be changed at any time without any notification.
- Termination: Cancellation can happen at any time. Written confirmation of cancellation is required from the client.
By using any of the services of Excel Business Insights the client hereby agrees to be bound by the Terms and Conditions of this Service Agreement.
